The information provided about you and your camera system will be for official use only. The Ladue Police Department based on the City’s Sunshine Policy hereby declares and finds that your completed registration form and the compiled registration list that will be maintained with names and contact information for all registrants of the Program and location and details about each registrants’ security system is a closed record under Section 610.021(20) and based on the reasoning within Attorney General Opinion 95-2001 and City of Springfield v. Events Publishing Co., LLC, 951 S.W.2d 366 (Mo. App. 1997), and, therefore, shall not be subject to disclosure under Chapter 610 RSMo. Despite this policy, it is possible that the information provided to the City of Ladue Police Department through participation in this Program could be ordered open, and subject to disclosure, by a court or a change in the law. Any footage containing or related to criminal activity collected by the City of Ladue Police Department may be utilized as evidence during any stage of a criminal proceeding. Therefore, any video footage obtained or copied from your security system shall be treated as Mobile Video Recordings, as defined by Section 610.010 RSMo. and, will be considered an open record subject to disclosure under certain circumstances in accordance with the Chapter 610 RSMo.
This program is entirely voluntary and you can withdraw consent of your camera information at any time by providing written notice to the Ladue Police Department. If necessary, the City of Ladue Police Department may contact you directly, utilizing the information provided by you at time of registration, to request the appropriate video surveillance footage. Any and all video surveillance footage shall remain your property until it is collected from you by the Ladue Police Department. Voluntary participation in this Program shall not be construed as an obligation to release any video surveillance to the Ladue Police Department when so requested, but rather authorizes the Department to contact you if the police suspect that your surveillance system, due to its location, may have captured relevant information.
Under no circumstance shall the registrants construe that they are acting as an agent and/or employee of the City of Ladue and/or the City of Ladue Police Department through this program. The City of Ladue Police Department will not request or obtain direct access or remote access to the camera equipment, security footage, or cloud stored data.
The City of Ladue (“City”) is committed to the safety and protection of its residents, businesses, and visitors to the City. This Community Camera Program (“Program”) asks residents and businesses, across the City, to assist the City in safeguarding their community by voluntarily registering their privately-owned video surveillance system with the Ladue Police Department.
Video surveillance is a modern tool that can assist the police in identifying, apprehending, and convicting suspects. As crimes occur nearby, many residents and business owners are unaware that their camera systems may have captured information that could help solve a crime. Likewise, police are not always aware of who may have potentially vital video evidence. Through this volunteer Program, if a crime occurs, the Ladue Police Department will be able to review the registration list of those businesses and residents who have voluntarily agreed to be part of this Program and contact them to review and, if applicable, collect/copy video footage that may be relevant to a current investigation.
